Ytterligare ett exempel på hur Sverige förvandlats till ett godtyckets högborg. Ett godtycke som är befäst i lagen. I vilket civiliserat land som helst finns det ordentliga skyddsmekanismer mot myndigheters ingripande och kränkande av de mest grundläggande rättigheterna. En av dessa är rätten att inte bli fråntagen sitt barn och att inte bli fråntagen sina föräldrar.
Vad hände med lagarna mot diskriminering och för likabehandling? Det är alltid lika intressant och nedslående att ta del av hur de offentliga rationaliseringarna ser ut när sådana hänsyn bortses ifrån. I allmänhet, så behövs det inte specificeras i någon detalj. Läser man till exempel en dom så kan ett helt koppel med grundläggande rättigheter ignoreras med en formulering i stil med; "något skäl till att bedöma det annorlunda i detta läget finner inte rätten..."
Man kanske inte ska bli så förvånad med tanke på att Sverige bedrev tvångssterilisering som baserades på rashygieniska hänsyn ända in på 80-talet. Det kanske inte är så konstigt att någon då tycker att föräldrar som är förståndshandikappade, även fast de nu inte är det egentligen, inte har några föräldrarättigheter.
I Sverige kan vilken socialsekreterare som helst tycka vad som helst och ta vilket barn som helst. För sanningen är den, att när väl det perfekta brottet är begånget. Så har myndigheterna alla systemets möjligheter att i efterhand konstruera de historiska omständigheterna för att motivera sitt agerande. Se bara på fallet med Dominic Johansson, hans pappa kallades för "mänskliga rättighetsextremister" av tjänstemännen. Det är nog bara i Sverige man kan råka ut för att bli kallad för extremist för att man anser att man har rättigheter som föräldrar.
Med den polariseringen i åtanke så ligger argumentationsnivån på ungefär samma nivå som i diktaturer där människor som uttrycker demokratiska åsikter klassas som till exempel "högerextremister" eller "vänsterextremister" beroende på hur smaken faller. I Sverige är det alltså "mänskliga rättighetsextremister" som är brännmärkningen för dagen. Hur länge ska det dröja innan den rättsrötan är rättad, barn växer, man har inte hur länge som helst på sig. Myndigheterna stormade planet Dominic satt på när familjen skulle flytta utomlands med beväpnad polis och kidnappad Dominic i juni 2009. Det är över tre år sedan.
För Lasse och Carin i Västervik har det gått elva år sedan de blev utsatta för det värsta brott en förälder kan råka ut för, att förlora sitt barn. De har blivit av med stämpeln som föranledde att de förlorade alla sina föräldrarättigheter, men har de fått tillbaka barnet för det? Nej. det har det inte. Har den myndighet eller tjänsteman, som fattade beslutet fått ta ansvar för det felaktiga beslutet? Nej. Har någon fått axla ansvaret och kompensera föräldrarna för det obeskrivliga lidande de orsakats? Nej.
Det är så det är. Inkompetens, illvilja, missriktat altruism och politisk dogmatism får agera fritt i Sverige och förstöra människors liv. Det kommer få fortgå så länge myndigheterna står över folket och inte tvärt om. Det kommer fortsätta så länge den svenska statsfilosofin är att lagarna är uttrycket för den goda och aggregerade folkviljan och per definition i ett evigt cirkelresonemang inte kan vara av ondo.
Därmed inget behov av en konstitution som kan fullföljas, inget behov av en författningsdomstol som kan utgöra en garanti mot statens övergrepp på enskilda, och därmed inget försvar mot att samhället alltmer glider mot totalitära uttryck. Nästan vad som helst kan motiveras med det infantila argumentet att det är "bra för barnen," och i ett system som rutinmässigt ställer barnet intresse i motsats till föräldrarnas, finns inga garantier.
Om staten kan åberopa tolkningsföreträde vad som avses med rättigheter så finns inga rättigheter, då finns bara av staten subventionerade privilegier, och privilegier kan man bli fråntagen när som helst.

This is yet another example of how Sweden has turned into a stronghold of arbitrariness. Official arbitrariness that is entrenched in the law. In any civilized country there are proper safeguards against official interference and violation of the most basic civil rights. One of these rights is the right not to be deprived of your children and not to be deprived of your parents.
What happened to the laws against discrimination and for equal treatment? It's always interesting and equally distressing to see how the Swedish official rationalization looks like when such considerations are disregarded. If one reads a judgment a whole brace of basic rights can be ignored with general wording along the lines of, "the court does not find any reason to judge it differently in this situation...”
Maybe one should not be so surprised, given that Sweden applied forced sterilization based on ideas of race hygiene up until the 80's. In light of that it may not be surprising that someone would think that parents who are mentally retarded, even though they actually are not, has no parental rights.
In Sweden, a social worker at any time, for whatever reason, can take any child into custody. Because the truth is, once the perfect crime is committed, the authorities have all the system's resources to retrospectively construct the historical circumstances to justify their actions. Just look at the case of Dominic Johansson, his father was called a "human right extremists" by officials. It's probably only in Sweden you may encounter being called extremist because you believe that you have rights as a parent.
With this polarization in mind the level of argumentation is about the same level as in dictatorships where people expressing democratic views are classified as either "right-wing" or "left-wing extremists" depending on which is deemed most stigmatizing. In Sweden, the words "human rights extremists" is the stigma of the day. How long will it be before the violations of these rights are corrected, children grows up fast. Authorities stormed the plane Dominic had boarded, with armed police when the family were about to move abroad. That was June of 2009. It's over three years ago.
For Lasse and Carin in Västervik, it is eleven years since they became victims of the worst crimes a parent might face, losing their child. They have been vindicated of the reasons which led to the loss of their parental rights, but have they got their child back as a result of it? No, they have not. Has the authorities or official who made the decision been held accountable for the erroneous decision? No. Has anyone assumed the responsibility and compensated the parents for the unspeakable suffering they have been subjected to? No.
That's how it is. Incompetence, malice, misguided altruism and political dogmatism may act freely in Sweden and destroy people's lives. It will be allowed to continue as long as the authorities are above the people and not vice versa. It will continue as long as the Swedish government’s philosophy is that the law is the expression of the good and the aggregated will of the people and by definition in a perpetual circular reasoning, can not be of evil.
Thus no need for a constitution that can be enforced. No need for a constitutional court that can offer a guarantee against state abuse of individuals and their rights and therefore no defense against a society that increasingly is sliding towards totalitarianism. Almost anything can be justified by the infantile argument, that it is "good for the children," and in a system that routinely makes the child’s interests adversarial to the their parents’, there are no guarantees.
If the state can invoke exclusive right to define rights, there are no rights, then there are only state subsidized privileges, and privileges may be removed at any time.
